What comes to my mind this morning is the recent arrest and the detention of one Mr. Abdulmalik Sa'idu, a student of the National Open University of Nigeria(NOUN) by order of the Katsina State Governor's aide-de - camp, Shehu Koko, a Deputy Superintendent of Police ( D.S.P.).
For those of us that read that news, it would be recalled that, according to his father,Mr.Abdulmalik Sa'idu was arrested and detained because he posted on his Facebook timeline details of the allegation of fertiliser scandal in the Katsina State.On the contrary, Mr.Abdulmalik was accused of cloning the phone number of the Governor of Kaduna State and using the number to call the state Commissioner for Local Government and Chieftaincy Affairs, Sani Makani, asking him to deposit the sum of three million naira in his (Abdulmalik's) account.Mr.Abdulmalik was arrested on 28th August,2014 and charged to court,by the police,on 22nd August,2014 after spending seventeen working days in the police custody.
Without prejudice to the two conflicting stories on both sides of the Mr.Abdulmalik's family and the police about what prompted the arrest of the young man, where my gists for the next few working days lie is the time length between the time of the arrest and the time he was eventually charged to court.Were the police still right to have held him in custody for seventeen working days before charging him to court over the allegation of fraud? If the police were wrong, does Mr. Abdulmalik have any remedies against the Nigeria Police Authority? Supposing,again, the police were wrong and all the role the police played in this scenario was tantamount only to acting the script of the Katsina State Government led by Ibrahim Shema, does Abdulmalik have any legal remedy against the Katsina State Government? If the answer to this is yes, does he also have legal remedy against the governor in his personal capacity?Besides, what is the state of Abdulmalik's right to the freedom of expression in the circumstances?
I have raised five issues from the scenario for legal discussion. Each of these shall be addressed in turn each working day starting from tomorrow, 26th September, 2014, on this blog. Watch out!
