I feel very sad this morning as a result of the removal of Linda Ikeji's blog from Google's blogging platform by Google over an allegation of intellectual property theft.Somebody somewhere actually filed a complaint with Google to bring down this lady's blog setting the law in motion against her.My gist for this morning is on this lady's case and it is about the conflict between law and morality that this development has given rise to.
On the legal side, as a lawyer, I want to say the law frowns upon lifting the intellectual works of others unauthorisedly and, nowadays, the law of intellectual property has been so wide that it even covers videos.It is beyond mere written works.The gist I want my reader to learn here is simply that these laws are there only waiting for one 'troublesome' fellow to invoke them.If you are writing a book or even a simple article an on-line post, be sure that the contents of your work are very original.However, while it is acknowledged that it is not possible not to refer to other people's work in your work, it is advisable to, at least, acknowledge the owner of the work you are borrowing.To be on the safer side, it is more preferable to get a written consent of that person to use his work because even if you acknowledge you still may not find it easy with the copyright owner.Maybe I should add here that this is the hazard of blogging as even bloggers now tend to pull each other down with this legal missile of copyright protection law.
On the moral side of it, I, first, want to ask why is it Linda? Why is she the only one being tormented? To be frank and honest, it will not be fair if Linda is not the only one found in this practice.If others too do the same thing but they are not touched just because nobody has queried their posts or works, it will not be fair.It is unfortunate that law can be too technical at times.If not, it would not have been out of place for Google to look beyond the motive behind this complaint against Linda.What if it was ill - conceived?
At any rate, let us all be diligent in whatever we do.
