A man in Nigeria bought two acres of land from a family with the consent of the family head and other members of the family.To this end, his counsel drew up an agreement wherein this family,among other things, undertook to bear any loss arising from claims in respect of the land by a third party.Some months after the transaction, the man (the purchaser) proceeded to clear the land of weeds and trees including some cash crops on the land.As the clearing process was about to start,the workmen were challenged by another person who claimed to be the owner of the crops on the land.He was then demanding to be paid the cash equivalent of the value of those crops before the land could be cleared.Who should settle this claim? Is it the purchaser or the vendor?
