Still on Mr. Abdulmalik's case.See my previous posts on www.mylegalgists.blogspot.com for a recap on our previous discussions. Having concluded that the police were wrong to have held Mr.Abdulmalik in detention for seventeen working days, the next question is as follows:

Does Mr.Abdulmalik have any remedies against the Nigeria Police Authority?

THE LEGAL POSITION
It should be borne in mind that Mr.Abdulmalik's detention by the Nigeria Police is unlawful. Section 35 (6) of the 1999 Constitution of the Federal Republic of Nigeria provides that Mr.Abdulmalik, in the circumstances, shall be entitled to compensation and public apology from the Nigeria Police Force.
