Good morning, friends.
First of all, I want to apologise for not posting on this blog on Wednesday,30th September 2014.It was due to my extremely-tight schedule for that day. I was on the road throughout that day. Again, I was absent from this platform yesterday, 1st October because it was a public holiday marking the 54th anniversary of Nigeria Independence.I was in a celebration mood too.Happy Independence to you all.
Today, I shall continue with Mr. Abdulmalik's case.The next question to be addressed now is as follows:
If the Katsina State Government is the complainant in the case and the Nigeria Police were only acting on the instruction of the Katsina State Government, does Mr. Abdulmalik have any remedies against the State Government?
LEGAL POSITION
Apart from the constitutional remedy mentioned in my last post, Mr.Abdulmalik can also sue the Nigeria Police joining the Katsina State Government through the Attorney - General of that state in an action for false imprisonment
In an action for false imprisonment against the Nigeria Police and the Katsina State Government, Mr.Abdulmalik can claim general damages and special damages.Note that he can only claim special damages if he can prove that he suffers a particular damage caused by his unlawful detention.
