The next question to be addressed is whether or not Mr.Abdulmalik has any remedies against the Governor of Katsina State in the circumstances.
THE LEGAL POSITION
Section 308 of the Constitution of the Federal Republic of Nigeria provides for the immunity of the president and that of the governors of the states of the federation to civil proceedings during the tenure of their offices generally.So, even if it can be established that the arrest and the detention of Mr. Abdulmalik was by order of the Governor of Katsina State in the circumstances, he cannot succeed in suing the governor during his tenure of office.He can, however,sue the governor after the expiration of his tenure of office subject to the limitation period for filing a civil action.
