Good morning, friends.
In Nigeria, it is a public nuisance for a person to pollute the atmosphere of his environment with emissions from his factory but the limitation to this rule is that a public nuisance is basically a crime which is actionable only by the Attorney - General of the state where it is committed. Nevertheless, a private person can still sue for this type of nuisance if he can prove that the damage he suffers is substantially greater than that suffered by other members of his community as a result of the nuisance.
ILLUSTRATION
You can sue for a public nuisance in your private capacity if your neighbour blocks the only road leading to a private school that you run thereby obstructing or delaying the flow of traffic to that school.Note that this is just one of the various possible scenarios.
AVAILABLE REMEDIES
The remedies available to a person suing for a nuisance are damages, an order of injunction restraining a further nuisance and an order of abatement.
