A woman in my neighbourhood bought some items that she really needed at a supermarket on credit.She actually pledged the credit of a man she is cohabiting with.When contacted for the settlement of the debt, the man said he was not married to the woman and that they were only cohabiting.In the Nigerian law, can he be excused in the circumstances?

THE LEGAL POSITION
In the Nigerian commercial law, if a man and a woman are only cohabiting, the impression they give the outside wold is that they are legally married and, in the above scenario, it will be presumed that they are legally married.Note that the things bought by the woman must be necessaries and not items that are just of secondary importance to her.In the circumstances the woman is not required to present her marriage certificate before such transaction.Of course that will be absurd.

Therfore, in the above scenario, the man cannot be excused, he must pay for the items bought on his credit by his woman.
